As of January 6, 2023, employers are no longer required to reach out directly to previous employers to obtain drug and alcohol history information as required by 49 CFR 391.23(e)(1)-(3) and 382.413(a)).  A query conducted through the FMCSA Clearinghouse now satisfies that requirement, as set forth in 49 CFR 391.23(e)(4) and 382.413(b).

If InCheck is currently conducting searches for your company, InCheck will no longer be reaching out to previous employers directly to obtain drug and alcohol history information for FMCSA-regulated employers as of 01/06/2023.
